Drug and Alcohol Use

Students are prohibited from possessing, using, selling, distributing, procuring, or being under the influence of alcohol, drugs, or other controlled substances on CEC property, during in-person attendance at a CEC school, while riding in a CEC bus/vehicle, or taking part in a CEC school-sponsored or sanctioned event on or off CEC property.

Students violating this policy shall be subject to disciplinary actions, which may include suspension, expulsion, and/or referral to law enforcement.

For purposes of this policy, drugs and controlled substances include, but are not limited to: narcotic drugs, hallucinogenic or mind-altering drugs or substances, amphetamines, barbiturates, stimulants, depressants, marijuana (except for use under the approval process outlined in CEC’s Administration of Medical Marijuana policy), anabolic steroids, any other controlled substances as defined in law, or any prescription or nonprescription drug, medicine, vitamin, or other chemical substances not taken in accordance with CEC’s Medication Administration policy.

This policy also prohibits the use of substances that are represented by or to the student as any such controlled substance or what the student believes to be any such substance.

In situations in which a student seeks services from a CEC mental-services team member or information from a staff member for the purpose of overcoming substance abuse, parents/guardians shall be involved, and CEC shall make every effort to direct the student and parent/guardian to resources of help, including education and rehabilitation programs, unless exigent circumstances exist.

Information provided to students and parents about community substance-abuse treatment programs or other resources shall be accompanied by a disclaimer stating that CEC assumes no financial responsibility for the expense of drug or alcohol assessment, or treatment provided by other agencies or groups, unless otherwise required.

Tobacco Use

The use of tobacco and tobacco-type products, including vaping equipment, is prohibited for students, teachers, staff, and visitors on CEC property, during in-person attendance at a CEC school, while riding a CEC bus/vehicle, or taking part in a CEC school-sponsored event or activity held on or off campus. Students violating this policy shall be subject to disciplinary actions that may include suspension and/or expulsion from school.

Tobacco means any cigarette or other product that contains nicotine or tobacco, or is derived from tobacco, that is intended to be ingested or inhaled by, or applied to the skin of an individual, as well as any electronic device that can be used to deliver nicotine by inhaling from the device including, but not limited to an electronic cigarette, rolling papers, cigar, cigarillo, pipe, water pipe, and hookah pen.

Use means the lighting, chewing, smoking, inhaling, vaporizing, ingesting, or applying to the skin any cigarette, tobacco, nicotine, or any other substance other than Food and Drug Administration-approved substances or devices.

This policy does not prohibit any product that the Food and Drug Administration has approved for use as a tobacco-use cessation product. However, due to the wide range of nicotine levels available in tobacco-cessation products, and the potential for abuse or toxicity, the school must receive written notice with dosage recommendations from a health-care provider for anyone under 18 to use a tobacco-cessation product, in accordance with CEC’s Medication Administration policy.

CEC prohibits the use or possession of vaping equipment on CEC school grounds, during in-person attendance at a CEC school, or at CEC school-sponsored events held on or off campus. The use of vaping devices, weed pens, e-cigarettes, and the like is prohibited. This includes any electronic device that can deliver vaporized or aerosolized nicotine solutions, non-nicotine solutions, tobacco solutions, and flavored or caffeinated vapor.

Because some CEC campuses share facilities with other institutions, signs regarding this prohibition shall be displayed prominently on all CEC Network school property that students have access to.
